1. Scope and Contracting Party
1.1 Provider
These Terms and Conditions (hereinafter "T&C") govern the use of the mobile application CrewPlan (hereinafter "App") and the premium service CrewPlan Pro contained therein (hereinafter "Pro" or "Pro subscription").

1.2 Users
A user within the meaning of these T&C is any natural or legal person who downloads or uses the App, regardless of whether a user account is created (hereinafter "you" or "User").
1.3 Applicability
By downloading, installing, or using the App, you agree to these T&C. You confirm this within the App upon first launch, before entering the home screen, by actively ticking both acceptance checkboxes (T&C and Privacy Policy). Without this confirmation, use of the App is not possible. If you do not agree to the T&C, you may not use the App.
These T&C apply in addition to the terms of the respective App Store (Apple App Store, Google Play Store). In case of doubt, these T&C take precedence over the Store terms to the extent permitted by law.
1.4 Minimum Age
Use of the App requires that you are at least 16 years old. Users under the age of 16 may only use the App with the express consent of a parent or guardian. By using the App, you confirm that you meet the minimum age requirement or have obtained the necessary consent.
1.5 Definitions
The following terms are used consistently throughout these T&C:
"App": the CrewPlan mobile application for iOS and Android.
"Provider" / "we" / "us": Marcel Jonik, operating under the CrewPlan brand (full contact details in section 1.1).
"User" / "you": any natural or legal person who downloads or uses the App, regardless of whether a user account has been created.
"Account": a registered user account created by providing an email address or via Google Sign-In or Apple Sign-In.
"Crew": a group created within the App whose members can jointly manage and share content.
"Pro" / "Pro subscription": the paid premium subscription CrewPlan Pro, which unlocks additional features.
"Group Benefits": selected Pro features that a Crew founder with an active personal Pro subscription can extend to the members of their Crew.
"App Store": the Apple App Store (Apple Inc.) or the Google Play Store (Google LLC), through which the App is downloaded and the Pro subscription is purchased.
2. Usage Models
2.1 CrewPlan Free (without account)
CrewPlan can be used without registration. On first launch, an anonymous user account is automatically created (without an email address or password), enabling basic app features. Without a registered account, the following is not possible:
Re-logging in after signing out or switching devices
Accessing previous content and group activities after switching devices
Syncing across multiple devices
Subscribing to a Pro subscription
Users without a registered account have no entitlement to recovery of their data after signing out or switching devices.
2.2 CrewPlan with Account (free)
By creating a free user account, extended features become available, in particular the ability to log back in and access your data after switching devices. Creating an account requires a valid email address (or use of Google Sign-In or Apple Sign-In) and acceptance of these T&C and the Privacy Policy.
You are required to provide truthful and complete information when registering and to keep it up to date. You are responsible for the security of your account and password and must notify us immediately if you have reason to suspect misuse. User accounts are personal and may not be transferred to third parties.
2.3 CrewPlan Pro (Premium Subscription)
CrewPlan Pro is a paid subscription that unlocks additional features. A registered, active user account is required to subscribe to personal Pro. Pro can alternatively be acquired at crew level (Crew Pro); in that case, the terms of the respective crew upgrade apply. The current scope of features is available in the App and at www.crew-plan.de/pro.
3. CrewPlan Pro — Subscription
3.1 Subscribing
The Pro subscription is purchased through the respective App Store (Apple App Store for iOS, Google Play Store for Android). A binding contract for the Pro subscription is formed upon confirming the purchase in the App Store. The terms of the respective App Store govern the purchase process, payment processing, and invoicing.
3.2 Term and Automatic Renewal
The Pro subscription is available as a monthly or annual subscription. The subscription automatically renews for the selected period (one month or one year) unless cancelled before the end of the current billing period. Cancellation terms are governed by the respective App Store.
3.3 Cancellation
You may cancel your Pro subscription at any time with effect from the end of the current billing period. Cancellation is only possible via:
the subscription management in your Apple ID account (iOS), or
the subscription management in your Google account (Android).
Cancellation by email or directly to us is not possible, as payment processing takes place exclusively through the respective App Store. After cancellation, you will continue to have access to Pro features until the end of the already paid billing period.
3.4 No Trial Period
CrewPlan Pro is offered without a free trial period. The subscription term begins immediately upon purchase.
3.5 Price Changes
We reserve the right to change the price of the Pro subscription at the start of a new billing period. Price changes will be communicated with at least 30 days' advance notice as follows:
by email to the registered email address (registered users), and
via the respective App Store platform (Apple App Store / Google Play Store) in accordance with their own policies for notifying users of subscription price changes.
If you do not agree to the new price, you may cancel the subscription before the change takes effect.
3.6 Discounts and Special Offers
We may, at our discretion, offer limited-time discount codes, special offers, or promotional prices. There is no entitlement to discounts or special offers. We reserve the right to change or discontinue such offers at any time without prior notice.
3.7 Scope of CrewPlan Pro Features and Right to Amend
CrewPlan Pro extends the capabilities beyond the free tier in the following areas: crew and member limits, polls, packing lists, announcements, and file storage. A complete and always up-to-date overview of all Pro features and limits is available at www.crew-plan.de/pro. The feature description published there forms part of these T&C.
We reserve the right to adjust the scope of CrewPlan Pro features at any time — both by adding new features and by modifying or removing existing ones. We will provide reasonable advance notice of material changes (see section 11). There is no entitlement to a specific, unchanged scope of features, provided that the core service of the subscription is maintained. If a material reduction in Pro features results in a significant deterioration of the service, you have the right to cancel the subscription early at the end of the current billing period.
3.8 Pro Group Benefits
If you, as a group founder, hold an active personal Pro subscription, selected Pro features may be extended to the members of your group within that group (hereinafter "Group Benefits"). The following applies to Group Benefits:
Group Benefits only exist for the duration of your active Pro subscription.
Group Benefits end immediately if your Pro subscription expires, is cancelled, or you are removed as group founder.
Group Benefits also end for a member if that member is removed from the group or leaves, or if the group is dissolved.
Members have no legal entitlement to Group Benefits. The availability and scope of Group Benefits may change at any time.
Group Benefits do not replace a personal Pro subscription and do not entitle the use of Pro features outside the respective group.
4. User Obligations and Rules of Use
4.1 General Obligations
You agree to use the App only for lawful purposes and in accordance with these T&C. You are responsible for all activities that take place under your account and for all content you upload, share, or otherwise distribute via the App.
4.2 Prohibited Content
You are prohibited from uploading, sharing, or distributing content via the App that:
violates applicable law (in particular criminal law, copyright law, data protection law),
is unlawful, offensive, threatening, hateful, discriminatory, pornographic, or otherwise objectionable,
contains malware, viruses, trojans, or other harmful code,
infringes copyright, trademark, or other intellectual property rights of third parties for which you do not hold sufficient usage rights,
contains personal or private information about third parties without their consent (e.g. photos, contact details),
constitutes commercial advertising, unsolicited bulk messages (spam), or chain letters,
jeopardises the integrity, operation, or security of the App or the underlying infrastructure.
We accept no liability for content uploaded or shared by users. If unlawful content is reported to us, we will review it and, upon confirmation of a violation, remove it without undue delay. The Provider is not a content operator within the meaning of the DDG, but reserves the right to remove content.
4.3 Netiquette
You agree to interact with other users in the App in a respectful and constructive manner. In particular, the following is prohibited:
insulting, abusing, or threatening other users,
spreading misinformation or false reports,
coercing or harassing other users,
incitement to hatred, violence, or discrimination,
impersonating other persons or users.
4.4 Reporting Obligation
You are encouraged to report unlawful content or conduct by other users that you encounter in the App without undue delay via the in-app support or by email to info@crew-plan.de. We will review reported content and take appropriate action.
4.5 Data Sharing within Groups
You acknowledge and agree that content you share or upload within a group is visible to all members of that group. You bear sole responsibility for ensuring that you are entitled to share such content and that sharing does not infringe the rights of third parties.
4.6 Technical Requirements
You are responsible for ensuring that the device you use meets the minimum technical requirements for using the App. We accept no liability for the App failing to perform on any particular device.
5. Usage Rights and Licence
5.1 Grant of Licence
We grant you a non-exclusive, non-transferable, revocable, personal licence to use the App on your own devices in accordance with these T&C. All rights not expressly granted remain with the Provider.
5.2 Prohibited Actions
You are expressly prohibited from:
selling, sublicensing, renting, or otherwise transferring the App or parts of it to third parties, whether for a fee or free of charge,
decompiling, disassembling, reverse engineering, or otherwise extracting the source code of the App,
modifying the App, creating derivative works, or integrating parts of the App into other software,
circumventing or disabling any security measures or copy protection mechanisms of the App,
using the App to send automated requests (bots, scrapers) to our servers,
using App content for commercial purposes outside the intended use.
5.3 Licence to User Content
For content you upload or share in the App (e.g. images, text, files), you grant us a non-exclusive, worldwide, royalty-free licence to use such content solely for the following purpose:
providing and technically operating the App features (strictly necessary for the App to function).
This licence is limited to what is technically necessary and ends upon deletion or anonymisation of your account. Any use of your content for marketing, advertising, or other commercial purposes beyond technical operation of the App will only take place with your separate and explicit consent.
6. Account Suspension and Termination
6.1 Suspension by the Provider
We are entitled to temporarily suspend or permanently delete a user account in the event of a breach of these T&C, misconduct, or reasonable suspicion of misuse. In the case of serious misconduct, a suspension may extend across accounts, meaning re-registration with the same or a different email address may also be excluded (ban). You have no entitlement to the reinstatement of a suspended or deleted account.
If a Pro subscription is active at the time of suspension, there is no entitlement to a refund of subscription fees already paid where the suspension is based on a breach of these T&C. The ability to cancel the subscription through the App Store is unaffected.
6.2 Account Deletion by the User
You may request anonymisation of your account at any time by emailing info@crew-plan.de. We will process your request within one month. After anonymisation, your personal data (email address, name, login credentials) will be removed; content you previously created in groups (e.g. expenses, tasks) will remain in anonymised form to avoid disrupting the group experience for other members. Please uninstall the App after anonymisation to remove any locally cached data.
7. App Availability
We endeavour to keep the App in an operational state. However, there is no entitlement to permanent, uninterrupted availability. The App may be temporarily unavailable in particular due to:
maintenance work and updates,
technical disruptions on our part or at third-party providers (e.g. server outages),
force majeure or other events outside our control.
We are entitled to discontinue the operation of the App or materially change the offering at any time if required for economic, technical, or legal reasons. In such a case, we will inform registered users by email with reasonable advance notice.
8. User-Generated Content and Disclaimer
8.1 No Pre-Screening of User Content
We do not review content created, shared, or uploaded by users in the App in advance. We therefore give no warranty as to the accuracy, completeness, currency, or lawfulness of user-generated content. You use content shared by other users at your own risk.
8.2 Expense Tracker and Calculated Values
The App contains features that perform calculations based on user input (e.g. the expense tracker for splitting costs). We accept no liability for the accuracy or completeness of such calculations. Errors in calculation, incorrect user input, or technical malfunctions may lead to incorrect results. Calculations by the App are not to be understood as binding financial advice or accounting services.
9. Liability
9.1 Limitation of Liability
We are fully liable for damages arising from injury to life, body, or health, as well as for damages resulting from intent or gross negligence, fraudulently concealed defects, and liability under the Product Liability Act.
Otherwise, our liability is limited to foreseeable, typically occurring damage. We are not liable in particular for:
data loss attributable to inadequate data backups,
damages caused by incorrect or incomplete calculations by the App (in particular the expense tracker),
damages caused by content uploaded or shared by users,
damages caused by temporary unavailability of the App,
damages caused by inadequate devices used by the user,
indirect damages, lost profits, or other consequential damages to the extent not covered by paragraph 1 above.
9.2 Liability for User-Generated Content
We are not liable for content uploaded, shared, or otherwise distributed by users in the App. The respective user is liable for the content they generate and shall indemnify us against claims by third parties arising from legal infringements caused by their content.
9.3 Liability for Loss of Access (Use without Registered Account)
Users without a registered account have no entitlement to recovery of their data after switching devices or apps. We are not liable for the loss of content or access caused by the absence of registration.
10. Data Protection
The processing of personal data in connection with the use of the App is carried out in accordance with our Privacy Policy, available at www.crew-plan.de/app-datenschutz, which forms part of these T&C.
11. Amendments to the T&C
We reserve the right to amend these T&C at any time. We will notify registered users of material changes by email to their registered email address at least 30 days before the changes take effect. The current version of the T&C is always available at www.crew-plan.de/agb.
Since you actively accepted these T&C at first launch — including the acknowledgement that updates are communicated in the manner described above — continued use of the App after a change takes effect constitutes acceptance of the amended T&C. If you do not agree to the amended T&C, you may request anonymisation of your account (registered users) or uninstall the App (anonymous users).
12. Right of Withdrawal and Consumer Rights
The Pro subscription is purchased exclusively through the Apple App Store (Apple Inc.) or Google Play Store (Google LLC). The purchase contract is formed between you and the respective App Store operator; we are not the contracting party to the payment transaction.
The statutory right of withdrawal for consumers in respect of distance contracts for digital content and services is therefore governed by the terms and conditions and withdrawal policy of the respective App Store. We recommend reading Apple's and Google's cancellation policies before making a purchase.
To the extent a right of withdrawal can be exercised directly against us (e.g. for other paid services outside the App Store): the right of withdrawal expires once performance has begun with your express prior consent and acknowledgement that you thereby lose your right of withdrawal.
13. Consumer Dispute Resolution
Notice pursuant to § 36 VSBG: We are not willing and not obliged to participate in dispute resolution proceedings before a consumer arbitration board.
14. Governing Law and Jurisdiction
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). If the user is a consumer resident in an EU member state, the mandatory consumer protection provisions of their state of residence also apply.
For disputes arising from or in connection with these T&C, the place of jurisdiction is, to the extent permitted by law, Cologne, Germany. The statutory place of jurisdiction applies for consumers.
15. Severability Clause
Should individual provisions of these T&C be or become wholly or partially invalid or unenforceable, this shall not affect the validity of the remaining provisions. The invalid or unenforceable provision shall be replaced by a valid provision that comes closest to the economic purpose of the invalid provision. The same applies to any gaps in these T&C.
